Ukrainian Courts Ruled in Favour of IATA in 27 Related Cases

ArsLegem’s partner Oleksandr Petrov successfully represented International Air Transport Association (IATA) in 27 court cases related to insolvency and subsequent bankruptcy of Aerosvit airline. Oleksandr acted as a Ukrainian law co-counsel to one of the international law firms.

A number of travel agents filed lawsuits in Ukraine against International Air Transport Association during the period of last two and a half years. In total there were 27 lawsuits with financial claims triggered by insolvency of Aerosvit airline. Due to the well-coordinated actions of the litigation team and advanced litigation strategy all of 27 cases were ruled in favour of IATA. Most cases, in addition to the courts of the first instance, were also considered by appeal courts and courts of cassation, including the Supreme Court of Ukraine. As a result International Air Transport Association (IATA) and its member airlines were relieved from reimbursement of unreasonably claimed multimillion damages.
